Terms & Conditions of The Luxury Savvy LTD

1. Introduction

 

1.1 The Luxury Savvy Ltd (“we”, “us”, or “our”) operates a retail business specialising in the sale of authentic, pre-owned luxury fashion items. While items may be sourced from private individuals, all sales to buyers are made by The Luxury Savvy Ltd, which acts as the seller and contracting party for all purchases completed through our website.


1.2 These Terms are effective as of 25th November 2022, and they govern your use of our services. Please read them carefully before proceeding.


1.3 If you do not agree with any part of these Terms, you must not use our website or services.


2. Definitions

 

2.1 Buyer: A person who purchases an item from The Luxury Savvy Ltd.

2.2 Seller: A private individual who supplies a pre-owned item to The Luxury Savvy Ltd for resale.

2.3 Item: A pre-owned luxury fashion product offered for sale by The Luxury Savvy Ltd.

2.4 Website: The online retail website operated at www.theluxurysavvy.com.

3. Use of Our Services


3.1 Eligibility: To use our marketplace, you must be at least 18 years of age. By using our platform, you represent and warrant that you are of legal age to enter into a binding contract.


3.2 Account Creation: While we do not require buyers to create an account to purchase items, sellers are encouraged to create an account to manage listings and transactions.


3.3 Account Responsibility: If you create an account with us, you are responsible for maintaining the confidentiality of your account details, including your password, and for all activities that occur under your account.

 

3.4 Contractual Relationship: For the avoidance of doubt, when a Buyer places an order through our website, the contract of sale is formed directly with The Luxury Savvy Ltd. The Luxury Savvy Ltd is responsible for fulfilment, delivery, refunds and statutory obligations to the Buyer.

 

4. Item Listings


4.1 Seller Responsibilities: Sellers must ensure that all items listed for sale on The Luxury Savvy marketplace are authentic, accurately described, and in accordance with our listing guidelines. Sellers must provide clear, accurate, and complete information, including photographs, descriptions, and condition of the item.


4.2 Item Condition: All items must be pre-owned and in a condition described by the seller (e.g., pristine, excellent, or used). Sellers must also ensure that they have obtained any necessary consents or rights to sell the items, including proof of authenticity.


4.3 Seller Fees: The Luxury Savvy charges a commission on each successful sale, deducted from the final sale price. Our commission rates are determined by the listing price and item category, as outlined below:

• Hermès bags listed over £10,000, and all other items listed over £10,000:

Commission rate: 12.7% 

• Items listed between £2,000 and £9,999.99:

Commission rate: 20%

• All other items and brands listed under £2,000:

Commission rate: 30%


Commission rates are applied at the time of sale and are non-negotiable unless otherwise agreed in writing prior to listing.


Example 1:

A seller lists a Chanel Classic Flap bag for £3,000.

• This falls under the £2,000–£9,999.99 bracket.

• 20% commission on £3,000 = £600

• The seller would receive £2,400 after commission is deducted.


Example 2:

A seller lists a Hermès Birkin bag for £12,000.

• This qualifies for the 12.7% commission rate.

• 12.7% of £12,000 = £1,524

• The seller would receive £10,476 after commission is deducted.


4.4 Item Authentication: The Luxury Savvy reserves the right to authenticate any item listed for sale. We use a combination of AI-powered technology and expert authentication services to verify the authenticity of items sold.

All items are subject to authentication and quality control checks prior to payout. The Luxury Savvy reserves the right to withhold payment or adjust commission if discrepancies or unauthorised items are identified.

 

4.5 Collection of Unsold, Rejected or Returned Items: Where an item is not accepted for sale, is withdrawn from sale, remains unsold, or is otherwise available for collection, the Seller is responsible for arranging collection within 7 calendar days of being notified by The Luxury Savvy Ltd.

For the purposes of this clause, notification shall be deemed given when The Luxury Savvy Ltd sends written notice by email, WhatsApp, text message, or any other contact method previously provided by the Seller.

Collections are strictly by appointment only and are subject to availability.

The Luxury Savvy Ltd will ordinarily offer no more than three collection appointments. Any additional appointments shall be entirely at the discretion of The Luxury Savvy Ltd and may be offered where exceptional circumstances apply.

If the Seller fails to attend a scheduled appointment, repeatedly cancels, or does not collect the item within the collection period, The Luxury Savvy Ltd may require collection by courier or such other reasonable collection arrangements as it considers appropriate.

Items that are not listed for sale cannot be retained indefinitely. Sellers are responsible for arranging collection, providing courier instructions, or otherwise agreeing alternative collection arrangements within the collection period.

Where an item is not collected within 7 calendar days and no alternative arrangement has been agreed in writing, The Luxury Savvy Ltd reserves the right to charge reasonable storage, handling, transportation and administrative fees and/or return the item to the Seller at the Seller’s expense.

Where an item remains uncollected after the collection period and the Seller has failed to arrange collection, provide courier instructions, respond to communications regarding collection or return, or otherwise make reasonable arrangements for recovery of the item, The Luxury Savvy Ltd reserves the right to dispose of, recycle, destroy, donate, or otherwise deal with the item as it considers appropriate.

The Seller acknowledges that The Luxury Savvy Ltd shall have no obligation to retain, store, safeguard, or make available for collection any uncollected item beyond the collection period specified in this clause.

The Luxury Savvy Ltd shall not be liable for any inconvenience, travel costs, loss of earnings, storage costs, or other losses arising from a Seller’s failure to attend a confirmed collection appointment, respond to collection notices, or arrange collection of an item within the collection period

 

5. Returns and Refunds

 

5.1 General Return Policy

All items sold by The Luxury Savvy Ltd are pre-owned and sold as described. Pre-owned items may show signs of wear or may have disclosed imperfections or faults, which are reflected in the item’s description, photographs, condition grading, and pricing.

 

Due to the nature of pre-owned luxury goods, we do not accept returns for change of mind, preference, suitability, or buyer’s remorse. This does not affect your statutory rights under the Consumer Rights Act 2015.

 

Any fault, imperfection, wear, repair, or defect that is clearly described or shown in photographs prior to purchase forms part of the item’s description and is not considered a fault for the purposes of returns or refunds.

 

5.2 Returns and Refunds Permitted by Law

Refunds and returns are available only where an item:

• is faulty due to an undisclosed material defect,

• is materially not as described, or

• is confirmed to be inauthentic.

No other refunds will be issued.

 

5.3 Returns and Refunds Procedure


Inauthentic Items

If a Buyer believes an item is inauthentic, they must notify us in writing within 14 days of receipt. We may require written confirmation from the original brand or an authorised brand representative. Returns will only be accepted once inauthenticity has been verified.

 

Not as Described or Undisclosed Faults

If an item is materially not as described or has an undisclosed material defect, the Buyer must notify us in writing within 14 days of receipt. We will assess the claim and may approve a return where appropriate.


Return Conditions

Approved returns must be sent back in the same condition as received, including all original packaging, accessories, tags, and authenticity documentation. Items that have been used, altered, damaged, or handled beyond normal inspection will not be accepted.


Return Shipping

Where a return is approved due to an error on our part, including undisclosed material defects, misdescription, or confirmed inauthenticity, The Luxury Savvy Ltd will cover reasonable return shipping costs.

In all other cases, return shipping is the responsibility of the Buyer.


Refund Processing

Once an approved return has been received and inspected, refunds will be processed within 5–7 business days to the original payment method used at checkout.


5.4 Final Sale

All items are sold on a final sale basis. No returns or refunds will be accepted outside the circumstances expressly set out in this Section 5.

 

6. Missing, Lost or Undelivered Orders:

 

Once your order has been dispatched, you will receive tracking information via email or text. All parcels are shipped through trusted third-party couriers and may include photographic proof of delivery.


If your order is marked as delivered but you believe it hasn’t been received, you must contact us within 48 hours of the delivery scan. Claims made after this period may not be accepted, and The Luxury Savvy will not be held responsible for missing items reported outside this timeframe.


It is the responsibility of the customer to monitor tracking updates and select safe delivery options — including safe place instructions, redirection, or delivery to a neighbour. If no preference is selected and the parcel is left unattended, this is done entirely at the customer’s own risk.


This applies to all orders, including high-value and international shipments. We strongly recommend choosing tracked and signed delivery options where available. For international deliveries, any customs duties, delays, or handling fees are the responsibility of the customer.


In the event a parcel is reported as missing, we will assist with the courier’s investigation. We may require you to complete a claims form or provide supporting evidence such as a police reference number in order to proceed.

 

7. Pricing and Payments

 

7.1 Pricing: All prices listed on The Luxury Savvy marketplace are in GBP (£) and are inclusive of VAT, where applicable. Prices are subject to change without notice.


7.2 Payment Methods: We accept payment through major credit cards and other electronic payment methods supported by our platform.


7.3 Payment Processing: Payments are processed securely through our payment gateway, and The Luxury Savvy does not store credit card information.


7.4 Seller Payments: Once an item is sold and payment has been received, The Luxury Savvy will remit the agreed-upon percentage to the seller. Payment to the seller will be processed within 5-7 business days after the item has been shipped to the buyer.


8. Authenticity and Fraud Prevention


8.1 Authentication Process: The Luxury Savvy uses a combination of AI-powered image recognition technology and expert verification to authenticate items listed for sale on our marketplace. In cases where we cannot verify authenticity, we may refuse to list the item for sale.


8.2 Fraud Prevention: We take fraud prevention seriously. If we suspect fraudulent activity, we reserve the right to suspend or terminate the account of any user involved in such activities.


9. Privacy and Data Protection


9.1 Privacy Policy: We are committed to protecting your privacy. Our Privacy Policy outlines how we collect, use, and protect your personal data. By using our services, you consent to the collection and use of your data as described in our Privacy Policy.


9.2 Data Retention: We will retain your personal data for as long as necessary to provide our services and comply with legal obligations.


10. Intellectual Property


10.1 Ownership of Content: All content on our website, including text, images, logos, and trademarks, is the property of The Luxury Savvy or its licensors and is protected by intellectual property laws.


10.2 Use of Content: You may not copy, reproduce, or distribute any content from The Luxury Savvy website without our prior written consent.


11. Limitation of Liability


11.1 Limitation of Liability: To the fullest extent permitted by law, The Luxury Savvy is not liable for any indirect, incidental, or consequential damages resulting from the use of our marketplace, including but not limited to loss of profits, business interruption, or loss of data.


11.2 Liability Cap: Our liability to you is limited to the value of the item purchased or sold on our platform.


12. Governing Law and Dispute Resolution


12.1 Governing Law: These Terms are governed by and construed in accordance with the laws of Scotland. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of Scotland.


12.2 Dispute Resolution: In the event of a dispute, we encourage users to contact us first to try to resolve the issue amicably. If we cannot resolve the issue, the dispute may be referred to mediation or arbitration, at our discretion.


13. Amendments to These Terms


13.1 Changes to Terms: The Luxury Savvy reserves the right to modify or update these Terms at any time. Any changes will be posted on this page, and the date of the last update will be noted at the top of the page.


13.2 Notification of Changes: We will notify users of any significant changes to these Terms via email or through our website.


14. Fraud and Misuse of Services


We reserve the right to recover any losses, including taking legal action where fraud, false claims or deliberate misuse of our services has taken place.
